Derains & Gharavi makes ICSID hire for new DC office

Paris disputes boutique Derains & Gharavi has recruited longtime ICSID senior counsel Eloïse Obadia, who will help to set up the firm’s first overseas office in Washington, DC.

Obadia, a French national, finishes today after 16 years with ICSID. She will join the firm as a partner next week, acting as both counsel and arbitrator, and dividing her time between Paris and DC. The new office is expected to open early next year.

Bahrain-based arbitrator Jan Paulsson says, “Once again Derains & Gharavi prove they think out of the box. Eloïse is a splendid lawyer in every way and will, in my view, perfectly complement the firm’s practice.”

Obadia joined ICSID in 1997 and has served as tribunal secretary in over 60 cases at the centre, including proceedings under the ICSID Convention, the additional facility rules and the UNCITRAL rules. She has also served as coordinator in an expert determination under the 1960 Indus Waters Treaty between India and Pakistan.

“I witnessed and took part in ICSID’s evolution and exponential growth, and now wish to continue in this same field but as counsel and arbitrator,” says Obadia. “Derains & Gharavi is a well reputed arbitration boutique with experienced lawyers from across the world. It is a great opportunity to join them and develop the practice in DC and in the Americas at large.”

ICSID secretary general Meg Kinnear says, “Eloïse has mentored many ICSID counsel and was a key contributor to our recent best practices and case management systems. We wish our friend every success in this next phase of her career.”

Before joining ICSID, Obadia was an associate with Curtis Mallet-Prevost Colt & Mosle, and a visiting lecturer at Duke University in North Carolina, where she completed her LLM. She also holds postgraduate qualifications from Paris II Panthéon-Assas and Paris-Dauphine universities, and is a member of the bars of Paris and New York. She is fluent in English, French and Italian, with a working knowledge of Spanish.

Obadia will be the fifth partner at Derains & Gharavi, which was founded in 2009 by Hamid Gharavi, Yves Derains and his son Bernard Derains, together with the late Serge Lazareff. While Lazareff left in 2010, Melanie van Leeuwen was recruited the following year from Loyens & Loeff.

In a statement, Derains & Gharavi said, “The firm is delighted to welcome Eloïse to the partnership. Her arrival will add another reputable partner to the team and reinforce senior staffing in the dozen investment cases it handles as counsel.”

The firm adds that the opening of the DC office will allow it to further develop its ICSID practice as well as its Latin America-related disputes work.

Launched in 2009, this Parisian boutique originally brought together two leading French arbitrators, Yves Derains and the late Serge Lazareff, with two younger partners, Hamid Gharavi (formerly of Salans) and Derains’ son, Bertrand. Though Lazareff left to join another boutique not long afterwards, the renamed Derains & Gharavi has gone from strength to strength to judge from the cases it is found on and its results.

It has extended that track record during the past year. The firm’s client, US radio investor Joseph Lemire, won big at ICSID. His opponent, Ukraine, was ordered to pay him US$8.7 million for breaching the US-Ukraine bilateral investment treaty. (The award hasn’t yet cleared the annulment phase.)

The firm helped to knock out early on one of the biggest cases in ICSID’s history: defending the government of Turkey in a US$19 billion telecoms expropriation claim filed by Dutch-Jordanian national Saba Fakes. The tribunal dismissed the claim as frivolous at the jurisdictional phase and ordered Fakes to pay Turkey US$1.5 million in costs. The firm also helped two Turkish telecoms companies fend off an attempt by Kazakhstan to annul a US$175 million award in their favour.

Both Yves Derains and Hamid Gharavi sit as arbitrator. At ICSID, Derains is hearing a highway construction claim against Peru, and a dispute between Spain’s Iberdrola and Guatemala. Gharavi, meanwhile is hearing a claim against Egypt brought by US H&H Enterprises Investments and has recently been appointed to hear a claim against Romania filed by a US businessman. Derains, who is a former secretary general of the ICC Court, was appointed chairman of the ICC Institute of World Business Law in 2010.

Recent events:
Dutch lawyer Melanie van Leeuwen has joined the firm as a partner. She arrived in September 2011 from Loyens & Loeff in Paris.

The firm recently won a pitch to represent French businessman Frank Charles Arif in his ICSID claim against Moldova over duty-free shops (as co-counsel with Moldovan law firm Paduraru Brasoveanu & Partners). The claim was registered just three months after Moldova ratified the ICSID Convention. Gharavi and associates Nada Sader and Cédric Soule are handling the case.

As well as featuring in GAR’s new “45 under 45”, Hamid Gharavi was on the working group which assisted with the recent reforms to French arbitration law. The firm also served as party-appointed French law experts in Dallah v Pakistan.
